CEDAR CITY – The Cedar City Police Department arrested a Cedar City man Sunday for rape and forcible sex abuse.
Gerald Wayne Santos, 56, was arrested and charged with one first-degree felony for rape and one second-degree felony for forcible sex abuse.
According to a probable cause statement, Santos encountered a 22-year-old woman out walking her dogs in the area of 550 W. 2000 North on May 15. He was working in the front yard of a vacant home as a part of his employment. The woman was described in the statement as having a “mental disability that makes her brain function similar to that of a small child with multiple limitations.”
The woman stopped to talk to Santos and they spoke with each other over an extended period of time. Santos asked the woman to go inside the home so he could show her something inside. Once inside, he took her into a closet and took off her leggings and proceeded to touch and then rape her, according to the statement.
During an interview at the Iron County Correctional Facility, Santos waived his Miranda rights and told police he and the woman had sex with their clothes on and that he exposed and touched parts of her body. Santos also said he could tell the woman appeared to have a mental disability.
Santos was booked into jail with bail set at $15,000, according to booking information. He has a court appearance set for June 18 at 9:30 a.m. in Fifth District Court in Cedar City.
Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
