ST. GEORGE — A Washington City man on the run from the law for drug distribution in Washington County is now facing first-degree felony charges of drug distribution, among other charges, after he was located and apprehended by law enforcement Thursday night.
On July 29, a $20,000 cash-only bail warrant was issued for the arrest of 32-year-old David Conwell after he failed to appear in court on drug distribution charges for which he had entered a guilty plea, according to Utah court documents.
Adult Probation and Parole agents located Conwell Thursday evening and placed him under arrest.
During the arrest and search of Conwell, a small caliber firearm was located in his room and a magazine clip was located on his person, according to a probable cause statement filed by Adult Probation and Parole in support of the arrest.
Additionally, two grams of heroin, packaging material and a scale were located in the room along with approximately 0.3 grams of heroin packaged for distribution, according to the statement. Agents also located one gram of methamphetamine.
Conwell was booked into the Washington County Purgatory Correctional Facility.
He was charged with two first-degree felonies for drug possession with the intent to distribute, a second-degree felony for possession of a dangerous weapon by a restricted person and a class B misdemeanor for possession of drug paraphernalia.
Because Conwell was previously convicted of drug possession with the intent to distribute in October 2014, his drug distribution charges were enhanced one degree. A single first-degree felony charge is punishable by up to a $10,000 fine and five years to life in prison.
Judge John Walton, of the 5th District Court, ordered $30,000 bail for Conwell’s release pending trial.
He was found indigent by the court during his initial court appearance Friday and will be represented by court-appointed attorney Douglas Terry. Conwell is scheduled to make his next court appearance Tuesday afternoon.
Persons arrested or charged are presumed innocent until found guilty in a court of law or as otherwise decided by a trier-of-fact.
